Terms of Service

These Terms of Service (“Terms”) govern your use of ZenZ Voice (the “Platform”), available at www.zenzvoice.com. By using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

1. What ZenZ Voice is

ZenZ Voice is a free, citizen-operated platform for reporting and discussing local civic issues, organized by geographic area. We host user-generated content as an “interactive computer service” within the meaning of Section 230 of the Communications Decency Act, 47 U.S.C. § 230. We host content posted by users; we do not author it.

2. Who can use the Platform

You may browse the Platform without an account. To post issues, react, or comment, you must create an account. You must be at least 18 years old (or the age of majority in your state) to create an account. By registering, you confirm that:

  • The phone number and email address you provide are ones you actually control.
  • The information you provide is true to the best of your knowledge.
  • You are responsible for keeping your password secure.

3. What you can do

  • Report local issues that you have observed or experienced.
  • Co-sign (“Me Too”) issues reported by other residents.
  • Comment on issues.
  • Optionally use the “Use my location” feature to auto-detect your local area, instead of picking it manually. See our Privacy Policy for how this works.
  • Request that we correct or delete information about you (see Privacy Policy).

4. What you must NOT do

You agree not to use the Platform to post or share content that:

  • Is defamatory, threatening, or constitutes harassment under applicable state law.
  • Incites imminent lawless action (within the meaning of Brandenburg v. Ohio).
  • Reveals the personally identifying information of other private individuals without their consent (doxxing).
  • Is obscene, sexually explicit, or harmful to minors.
  • Infringes copyright, trademark, or other intellectual-property rights. We respond to valid notices under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
  • Impersonates another person, organization, or government body.
  • Is deliberately false or misleading in a way that causes legally cognizable harm.
  • Is automated, spam, or commercial advertising not authorized by us.
  • Is intended to disrupt the operation of the Platform or compromise its security.

5. How moderation works

New issues are published immediately on the Platform. A moderator may, at any time, hide a post or ask for explanation if there is reason to believe the post is spam, misleading, or violates Section 4 above. We make every effort to respond to user complaints within a reasonable time and to act on valid DMCA notices in accordance with 17 U.S.C. § 512.

6. Account suspension and termination

We may suspend or terminate your account if we determine that you have violated these Terms. We will notify you by email when this happens. You may appeal a termination by replying to that email.

You may delete your account at any time by writing to voicezenz@gmail.com. We will delete your personal information within 30 days, except where retention is required by law or to defend against an active legal claim.

7. Content ownership and license

You retain all rights to the content you post. By posting, you grant ZenZ Voice a non-exclusive, royalty-free, worldwide license to display, reproduce, and distribute your content on the Platform, in aggregate analytics, and in transparency reports.

8. Disclaimers

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

ZenZ Voice does not guarantee that issues posted will be acted on by any government department or third party.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZENZ VOICE AND ITS OPERATORS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. OUR AGGREGATE LIABILITY TO YOU UNDER THESE TERMS WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).

10. Indemnification

You agree to indemnify and hold harmless ZenZ Voice and its operators from any claim arising from content you post or from your violation of these Terms, except to the extent caused by our own willful misconduct.

11. Dispute resolution and governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws provisions. Subject to any non-waivable rights under your state’s consumer protection laws, you and ZenZ Voice agree to resolve disputes through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You may opt out of arbitration within 30 days of first agreeing to these Terms by writing to the email address below.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced on the homepage and by email to registered users. The date at the top of this page shows when the Terms were last updated.
